<p><span><span><span><span><span><span><span>Adversarial fact-finding is the foundation upon which judicial decisions are built. However, appellate courts are sometimes聽forced to make assessments of fact in circumstances where there has not been a trial 鈥� 鈥榝acts without trial鈥�.
